The correct functioning of the memorial page is ensured by Foto Šimonka s.p. as the administrator of the offer.

The company guarantees the operation of the in.memoriam.si website in the individual part linked to the QR code and representing the memorial page of the deceased person for a period of at least 10 years from the date of the public presentation of the website. The company guarantees that the price of the agreed service will remain unchanged until the end of the subscription period. The website content administrator shall not be held liable for any interruptions in the operation or display of the website that are beyond the control of the company (interruptions in internet traffic, software maintenance, maintenance of server units, etc.) The subscriber will be informed in advance of any planned interruptions.

WARRANTY AND COMPLAINTS AND RETURN/EXCHANGE OF PRODUCTS

The offer consists of electronic and physical products. All products are inspected before delivery and dispatched undamaged. We will pack your products carefully.

The Buyer may claim if the goods do not have the characteristics expressly promised by the Seller, if the Seller has sent the wrong products, in the wrong quantity, colour or otherwise deviate from the Buyer’s order.

In the event of a complaint, the Buyer may, subject to legal restrictions, request the replacement of the item, its repair or a refund of the purchase price. In the latter case, the Seller reserves the right to charge rent at the current price list for the time the goods have been used by the Buyer, up to a maximum of the amount by which the market value of the goods has decreased during and as a result of the use.

The Buyer may return the goods for claim by bringing them in person to one of the Seller’s branches, or by returning them by post to the Seller’s address, at the Seller’s expense and by prior agreement with the Seller.

The Buyer shall have the right, in accordance with 37. under Article 4 of the Consumer Protection Act, in the event of a defect in the product, to request that the company replace the defective product with a new, faultless product or refund the amount paid or remedy the defect in the product or refund a proportion of the amount paid in proportion to the defect.

The replacement period is 14 days. Product exchanges can only be made on presentation of the invoice or. a copy of the invoice.

CREATIVE MISTAKES

The consumer may exercise his rights under the material defect law if he notifies the seller of the defect within two months of the date on which the defect was discovered. The consumer must describe the defect in more detail in the defect notification and give the seller the opportunity to inspect the item. The consumer can notify the seller of the defect in person, with a receipt from the seller, or by sending it to the shop where the item was bought or to the seller’s agent with whom the consumer has concluded the contract.

The Seller is not liable for material defects in the goods which become apparent after two years have elapsed since the goods were handed over. A defect in the item is deemed to have existed at the time of delivery if it occurs within six months of delivery. The consumer’s rights under paragraph 1 shall lapse on the expiry of two years from the date on which the consumer informed the seller of the material defect.
